HUF- HINDU UNDIVIDED FAMILY


HUF- Hindu undivided family comes under the Hindu Act. The nation being Hindustan, a special privilege is given to Hindus under Income Tax Act to have a separate file to consolidate the income of the family and pay tax accordingly. A Sikh, Jain, Buddhist etc are also part of Hindu and therefore they also enjoy the privilege like other core Hindus.

Obviously this is not allowed to Christians or Mohammedans (Muslims). The male head of the family is called the Kartha of the family and other male members are the co parceners irrespective of their age who may be the son; grandson, great grand son while the females are the members of the family. A Kartha is accountable and it is his responsibility to pool all the income of the family and pay tax and file the return of income of the family.

The individual member, either male or female who receives income in their individual capacity is nothing to do with the income of the family and gets assessed separately and the individual income does not form part of the HUF income. HUF properties are those which are acquired from the ancestors and all of them who are part of family have collective right, and by the corpus of the HUF they can carry on business or build on their property, acquire property, sell ancestral property and derive capital gains all those are assessed under the banner of HUF and separately taxed and the basic limit prescribed for any individuals will apply for HUF also. The normal rates as applicable to individual assessee shall apply for HUFs also.

Many Hindus are not aware of the privilege they have as a Hindu and in due course of time it merges into the individual income and thereby lose the benefit which they could have got by analyzing and segregating the income. There were too many occasions and the courts have dealt the subject in detail in many cases and as per the Hindu Law, they are in favour of separating the income even if it had mixed up earlier and assessed in the hands of Individual i.e. in the name of kartha.

What is required is that, the family should exist, Kartha should be established, there must be some nucleus of the family, and they belong to Hindu religion. When such basic requirements exist then a HUF could be established any time and corrective measures could be taken for the future. 

As said, they have collective right over the assets and liabilities of the family. As per the Hindu Act there are two types of families, Mithakshara and Dayabagha. The  individual rights as the member of the family depends on which type of school is followed by the family from the beginning. All the male members have equal rights over the properties and the females have right to the extent of maintenance and marriage. The male member can ask for the partition of the HUF assets and the female can not claim for the partition, but when assets are partitioned they have their right over their part of the amount for the maintenance and if they are unmarried, a amount that could be required for the purpose of the marriage. All the co parceners have equal right over the property and also the liability if any, on the family.

Before 1972, partial partition was recognized but from 1/4/1972 only full and final partition among all the co parceners is only recognized, on partition the divided portion falls on smaller HUF and only if there is no family then it will be assessed in individual capacity till he gets a family.

Such of those families who do not have a nucleus and common hotch pot is empty; it can be created by way of gift from the well-wishers of the family, which existed. Such gift should be very clear for the family’s perpetual succession.

There is no scope of making a will on HUF property as the Hindu Act comes into operation and the rights of male and females are well established. However he/she can make a will to the extent of his/her share.

What is a HUF : क्या है HUF

क्या आप उन लोगों में शुमार हैं, जिन्हें बेहतर एकाउंटिंग और कर बचाने के प्रावधानों के उद्देश्य के लिए अपनी पहचान को अलग कर देखने के तरीकों की तलाश रहती है? अगर ऐसा है तो आप उस वक्त से कुछ अंदाजा ले सकते हैं, जब लोग संयुक्त परिवारों में रहते थे और संयुक्त आमदनी बांटते थे। अगर आपने हिंदू अविभाजित परिवार (एचयूएफ) खाता खोला है तो आय कर बचाने के लिए भी आप इसी अवधारणा से मदद ले सकते हैं।


वास्तव में एचयूएफ अधिनियम के प्रावधानों के तहत आने वाले इस खाते से आप अपने भाई या पिता की लग्जरी कार चलाने का लुत्फ भी ले सकते हैं और अपने कारोबार में डेप्रीसिएशन क्लेम कर कुछ कर भी बचा सकते हैं। आइए हम आपको देते हैं इससे जुड़ी टैक्स सेविंग की जानकारी...

 

फ्लैक्सी-ऑप्शन

वैसे इसकी परिधि में केवल हिंदू परिवार ही नहीं आते बल्कि जैन, बौद्ध और सिख भी एचयूएफ बना सकते हैं। इसमें कम से कम दो सदस्य शामिल होते हैं जिनमें से एक पुरुष होता है और यह एक ही पूर्वज से सीधे तौर पर जुड़े होने चाहिए। लेकिन आप छोटे विभाजित परिवार भी एक पुरुष सदस्य के साथ एचयूएफ बना सकते हैं। 


उच्चतम न्यायालय के मुताबिक, अंतिम पुरुष सदस्य के निधन के बाद ही एचयूएफ में केवल महिला सदस्य बच सकती है। एचयूएफ में परिवार के सबसे वरिष्ठ सदस्य को कर्ता (मुखिया) के नाम से जाना जाता है। को-पार्सनर पुरुष होते हैं, जबकि महिलाएं सदस्य होती हैं। 


आम तौर पर कर्ता एचयूएफ की संपत्ति का प्रबंधन करता है। को-पार्सनर के पास विभाजन का अधिकार होता है, जो आम तौर पर एचयूएफ की संपत्तियां बांटने पर होता है। विभाजन की सूरत में सदस्यों को केवल रखरखाव मिलता है। एचयूएफ की संपत्ति में सदस्यों/कर्ता की ओर से दिए गए तोहफे या वसीयत में मिली जायदाद शामिल होती है।

 

टैक्स सेविंग में मददगार

आय कर अधिनियम के मुताबिक एचयूएफ एक अलग इकाई होती है और उसे व्यक्ति विशेष की तरह वही कर छूट मिलती है। केपीएमजी के एग्जिक्यूटिव डायरेक्टर विकास वसल ने कहा, 'यह स्लैब रेट और 80सी के तहत मिलने वाली कर छूट के योग्य होती है।' 1.5 लाख रुपए तक की आमदनी एचयूएफ के लिए कर मुक्त होती है और यह कारोबारी जायदाद, पूंजीगत लाभ या दूसरे स्त्रोतों से आने वाली आय का पैसा हो सकता है लेकिन इसमें तनख्वाह शामिल नहीं होती। 


एचयूएफ बनाकर कर छूट दो बार क्लेम की जा सकती है। अगर किसी व्यक्ति की सालाना आय 3 लाख रुपए है और उसने कर बचाने के लिए कोई निवेश नहीं किया है तो उसे 15,000 रुपए बतौर कर चुकाना होगा। लेकिन अगर यह व्यक्ति एचयूएफ का सदस्य है और कर के दायरे में आने वाली आधी रकम एचयूएफ के हाथों में जा रही है जबकि आधी उसके हाथ में तो उसे कोई टैक्स नहीं चुकाना होगा क्योंकि 1.5 लाख रुपए तक आमदनी पर कोई कर नहीं बनता।

 

दूसरे फायदे भी

पूर्वजों की वसीयत या फिर सदस्यों की भागीदारी से मिली कुछ संपत्ति के साथ एक बार एचयूएफ बन जाए, उसके बाद कर्ज लेकर और कारोबार के लिए जायदाद का इस्तेमाल कर उसकी संपत्ति का आधार बढ़ाया जा सकता है। एचयूएफ की कमाई में शामिल आमदनी पर केवल उसी के आधार पर टैक्स लगेगा और उसे किसी व्यक्ति विशेष की आय से जोड़कर नहीं देखा जाएगा। 


अगर कारोबार नाकाम होता है तो भी देनदारी सदस्यों की नहीं बनेगी। अर्न्स्ट एंड यंग में पार्टनर सोनू अय्यर के अनुसार एचयूएफ की देनदारी उसकी संपत्तियों तक सीमित है। इसलिए व्यक्तिगत क्षमता पर किसी भी सदस्य पर कोई देनदारी नहीं बनेगी।

 

याद रखिए

एचयूएफ का गठन पूरे परिवार की बेहतरी के लिए किया जाता है और इसलिए किसी भी कारोबारी फैसले पर सभी सदस्यों की राय शामिल होना जरूरी है। हर व्यक्ति को एचयूएफ की लंबी अवधि की संभावनाओं पर गौर करना चाहिए। 


आईट्रस्ट फाइनेंशियल एडवाइजर्स के को-फाउंडर धुव अग्रवाल ने कहा कि एचयूएफ कर छूट का फायदा देता है लेकिन आपको यह याद रखना चाहिए कि एचयूएफ के पूरी तरह विभाजित होने तक परिवार की आमदनी को एचयूएफ की आय के तौर पर आंका जाएगा। इसके अलावा हर सदस्य एचयूएफ की संपत्ति का मालिक होता है, ऐसे में उन्हें व्यक्तिगत हितों के लिए इस्तेमाल नहीं किया जा सकता।

Ever wondered what a HUF is?

A friend of mine earns income from a number of sources: rent, business and a salary. The other day, she mentioned she would like her family to get the status of a Hindu Undivided Family. She felt it would help her save on taxes.

It is rather obvious that a non-Hindu family cannot get this status. So, if you are a Parsi, Muslim or Christian, tough luck.

So, what is a HUF?

For starters, did you know the term 'Hindu Undivided Family' has not been defined under the Income Tax Act?

It is defined under the Hindu Law as a family that consists of all persons lineally descended from a common ancestor, including wives and unmarried daughters.

This means your membership into a HUF does not come from a contract but from your status.

A HUF cannot be formed by a group of people who do not constitute a family; lineal descendents with a common ancestor is a must.

In Maharashtra, unlike other states, even married daughters are recognised as HUF members.

Even though Jain and Sikh families are not governed by the Hindu law, they can still be treated as a 

Who are the players in a HUF?

A HUF consists of:

Karta

The karta has to be the oldest male in the family. If he passes away, his wife cannot become the karta. His eldest son will take his place. If he chooses not to, he can give up his right and the next son in line can take his place.

Coparceners

This is what all the male members are referred to as.

A Hindu coparcenary includes the sons, grandsons and great-grandsons of the holder of the joint family property. By virtue of their birth, they acquire an interest in the property.

Members

The female members are simply called 

Why is it important?

Under the Income Tax Act, a HUF is treated as a separate entity for the purpose of assessment. From this stems its importance.

However, the income of a joint Hindu family can be assessed as the income of a HUF Hindu only if the following two conditions are satisfied:

  1. There should be a coparcenary.
  2. There should be joint family ancestral property.

Other investments too can take place under the broad head of HUF.

For instance, a HUF can open a bank account in its name. The karta must open a HUF bank account in any bank by giving an undertaking on a stamp paper of Rs 100. The format will be supplied by the bank.

A demat account to buy shares can also be opened. Even post office deposits and a Public Provident Fund account can be opened in its 

Which income is regarded as HUF income?

There are five heads of income:

1. Salary
2. Profits from business or profession
3. Income from house property
4. Capital gains
5. Income from other sources

Since the HUF is a separate entity, it can earn income from all the above except income from salary.

All income that arises on the investment of the HUF's funds and utilisation of its assets is regarded as income and is separately assessed and 

How is it taxed ?

Though the HUF is taxed as separate entity, the tax slab which is applicable to an individual is applicable here too.

It also enjoys the Rs 1,00,000 deduction under Section 80C.

All the income tax slabs and deductions and exemptions available to individuals are also available to the HUF.

Let's take the case of Anil Shah.

He is a salaried individual but his family runs a business and owns a lot of property. Hence, they formed a HUF.

Anil will be individually taxed on his salary and all the tax breaks and deductions and exemptions will be applicable to him.

The HUF earns money from the business as well as rent from renting out the properties. The HUF will be taxed according to the various tax slabs and all the exemptions and deductions will also be available to it.

Let's say after paying the taxes, the HUF has a lot of profit. This profit can be divided to all the members and it will be totally tax-free in their hands since the tax has already been paid by the HUF.

Can it be partitioned?

Yes, the HUF can be partitioned.

This is actually a division of property where the share of each member is determined.

Only a male member -- a coparcener -- can enforce a partition. Female members cannot enforce a partition but are entitled to a share of the division (as per the Hindu law).

The shares are then divided between:

~ All coparceners
~ A son in the womb of his mother at the time of partition
~ Mother (gets an equal share if there is a partition between the sons and her husband has passed away)
~ Wife (gets a share equal to that of a son at the time of partition between father and sons)

If the karta passes away, the assessing income tax officer should be intimated of his death and the appointment of the new karta.
